- - - - - San Francisco To Limit Free Speech? NOT! - - - - -
I read Michelle Malkin frequently. I don't always, or even mostly, agree with her. But I found POTENTIAL IDIOCY there. And, it turns out that BLOGGERS ARE EXEMPT! I think they are, anyway. I sent off an email to Ms. Malkin with the pertinent info.
Here is the LINK to the proposed legislation. The pertinent sections are:
DEFINITIONS (3): "Electioneering Communication" shall mean any communication, including but not limited to any broadcast, cable, satellite, radio, internet or telphone communication ..."
|
However, Section 3Ci specifically EXCLUDES "independent expenditures", so I guess that I WON'T be moving back to the Bay Area to be a pain in the neck, thanks be to a benevolent God.
However, here is the little gem I would have sent off to the SF Board of Supes, if they'd really been trying it on for size....
My Dear (person's name),
Hooooeee!
You have GOT to be kidding!
My Dear Supervisor, I'm tempted to move back to the Bay Area (I left in '03, after living in the Bay Area for thirty-some-odd years), locate my bad self within the limits of the City and County of San Francisco, run up a bill with an ISP of $1001.27, post scurrillous political invective about the oh-so-brilliant folks on the Board of Supes, and then out-and-out dare, nay, BEG you to try to enforce that silly regulation upon my moldy old self.
My blog is currently at http://oww.blogspot.com, which is a free (to me) service. That's because I'm thrifty. There are, however, other providers who will gladly take my $1001.27 just to help me make my point.
I will claim persecution because of my political beliefs.
My political beliefs are centered upon The Constitution of the United States of America, specifically, as amended below:
"Article [I.] Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."
As you are an elected official, you durned well ought to know that political commentary has been consistently held by the Federal Courts, right up to the Supremes, as "protected speech". You can bet whatever you like that I'll be screaming bloody murder, all the while petitioning the Government for a redress of grievances.
In cash, please. LOTS of cash!
Sincerely,
Old Wierd Ward (Formerly of San Jose, CA. Currently resident in Camden County, GA. Considering a move to San Francisco, CA, just to be a pain-in-the-neck.)
