I have been perturbed for some time by the treatment afforded one Jose Padilla by the Department of Justice.
To review: Jose Padilla has been accused, sort of, of conspiring to construct a "dirty bomb" and set that sucker off somewhere in the US.
Padilla has been held for two years, mostly in solitary confinement, without the benefit of counsel, as an "enemy combatant".
Padilla has not been arraigned. He was not in Afghanistan or Iraq when arrested. He has not been allowed to see an attorney.
Padilla is an American citizen, and is, therefore, entitled to the protection of American law.
This "enemy combatant" crap is horse shit.
Padilla is either a traitor, or not.
Either way, he is entitled to his day in court, with counsel, under the laws of the US.
The United States is NOT in a declared State of War. Therefore, as I see it, habeus corpus still applies - "War on Terror" or not. The so-called "Patriot Act" under which Padilla is being held incommunicado is just that, an Act of Congress, and is of dubious legality.
Therefore, let's give Padilla his day in court. Then, if he's found Guilty, we can hang him out to dry.
